5.1 Speedy Inputs/Clearances
While the mechanisms introduced in
the Industrial Policy of 1994 have facilitated timely clearances, there
is considerable scope for improving the system. The time-schedules laid
down in the 1994 Policy have been further reviewed to compress the project
implementation time. These are indicated at Annexure-IV.
Clearance From The Pollution
Control Board
With the changed industrial climate
and to meet the needs of industry, Rajasthan Pollution Control Board instead
of merely performing a regulatory role would also take up promotional work
for increasing.
awareness regarding environment and
pollution control measures. This will help industry to adopt the necessary
safeguards. In the past three years, the Rajasthan Pollution Control Board
(RPCB) has taken a number of steps to facilitate the task of securing the
requisite approvals. Some additional measures proposed towards this end
are indicated in the succeeding section.
In appropriate cases RIICO, or any
other agency entrusted with the development of an Industrial Area, will
get the Environment Impact Assessment (EIA) and Environment
Management Plan (EMP) approved for the entire area or a particular
zone of that area by the Department of Environment. An Industrial unit
being set up in such area will not be required to secure site clearance
from the Department of Environment.
Haphazard growth of Industrial Units
in the vicinity of National and State Highways has been impeding the free
flow of traffic. Hence, in Industrial areas to be set up in future or on
private/Government land, industrial units will be permitted only in areas
beyond 150 metres from the centre of National/State Highways. However,
Cement Plants, Grinding Units and other highly polluting units shall not
be permitted within 300 Metres from the centre of National/State
Highways.
An Advisory Cell for Pollution
Control has been set up in the Rajasthan State Industrial Development and
Investment Corporation Limited. It will inform, advise and assist entrepreneurs
on aspects relating to Environment and Pollution Control.
A Guide Book on Environment
Protection Laws and Procedures will be brought out by the above Cell with
the help of Rajasthan Pollution Control Board.(RPCB).
Rajasthan Pollution Control Board
will set-up regional offices in major Industrial Areas and growth
centres in a phased manner. However, where such regional offices are not
set up, a nodal officer with requisite authority for environment-related
issues will be deputed to each District Industries Centre (DIC)
to help entrepreneurs in securing requisite clearances.
In case of SSI and Tiny units, nodal
officers will be authorised to issue No Objection Certificate (NOCs)
within 7 days provided the units belong to ‘Other Industries’ category,
and are located in an Industrial Area. The Board shall delegate necessary
powers to the nodal officers in DICs to enable them to accept applications
and NOC forms and carry out the basic formalities.
The Pollution Control Board will
adequately equip its laboratories so that they can carry out the required
checks and issue necessary certificates. In addition, the Pollution Control
Board will recognise reputed private Laboratories and Test Houses
for prescribed checks and issue of certificates.
The Pollution Control Board has reviewed
the existing list of Small Scale industries which are exempted from the
requirement of securing NOCs/Consents. The list has now been enlarged to
include 150, instead of earlier 115 industries. Details of such industries
are given in Annexure-V.
5.3 Labour Laws
5.3.1 The Labour Departrment will
bring out a Hand Book of various Labour Laws, Rules and Procedures for
guidance of industry and workmen.
In consultatin with the Industry
Associations a comprehensive review of State Labour Laws will be undertaken
to simplify and reorient them to meet the emerging requirements of Industry.
