            Subject: Filing of criminal complaint under section 24 read with section 29B (2A)/(2D) of the I(D&R) Act, 1951 against M/s. Ramswarup Industrial Corporation, Kolkata a large unit manufacturing Stranded wire - an item reserved for manufacture in the SSI sector - regarding.

Sir,

            Please refer to this office O.M. No. 21/5(9)/2005-SSI Bd. dated 2 September 2005 addressed to all Directors, SISI/Br. SISI including Secretary (Industries) all State/UTs containing guidelines for action against violation of reservation policy for exclusive production in SSI sector by non SSI units.

            From the O.M. No. 270/S-cot/05 dated 31.5.2005 of Ms. Meera Pandey, Principal Secretary (C & SSI), Govt. of West Bengal, it appears that Govt. of West Bengal is not initiating action against the violation of the policy of reservation against the above referred unit.. In the light of the above guidelines, you are requested to initiate prosecution against M/s. Ramswarup Industrial Corporation, Kolkata, a large unit manufacturing Stranded wire , an item reserved for manufacture in the SSI sector by engaging a legal consultant who is well versed in criminal matters within 15 days of the receipt of this letter and file a criminal complaint under section 24 read with section 29B (2A)/(2D) of the I(D&R) Act, 1951.  

            A copy of the act is enclosed for ready reference for filing the complaints. Enclosed are reports received from Department of IP & P, Secretariat for Industrial Assistance (PAB-IL Section) [letter. No. 134/IL/2003 dated 19.04.2004] , Directorate of Industries, West Bengal letter no. 611(1)/L (95)/319 Pt. 4 dated 11.12.2003 and Principal Secretary ( C & SSI ) Govt. of West Bengal (letter no. 270/S-Cot/05 dated 31.05.05 proving the violation by the unit concerned.

As mentioned at para (f) of guidelines, a fortnightly report be sent to this office stating the progress of the case

This issues with the approval of Additional Secretary to Government of India & Development Commissioner, SSI.
