Please refer to this office O.M. No. 21/5(9)/2005-SSI Bd. dated 2 September 2005 addressed to all Directors, SISI/Br. SISI including Secretary (Industries) all State/UTs containing guidelines for action against violation of reservation policy for exclusive production in SSI sector by non SSI units.
In this connection, letter No. 11-1-03-814 dated 21.3.2005 of Commissioner of Industries, Hyderabad (copy enclosed) may please be referred to. This letter speaks that action against the unit for violation of terms and condition of the FC approval may be initiated by this office. You are, therefore, requested to initiate prosecution against M/s. Tupperware India Pvt. Ltd. and M/s. Dart Manufacturing India Pvt. Ltd. by engaging a legal consultant who is well versed in criminal matters and file a criminal complaint against them under section 24 read with section 29B (2A)/(2D) of the I(D&R) Act, 1951. A copy of the Act is enclosed for ready reference. While filing the complaint the confidential report prepared by you about this company may be taken in account. Enclosed are reports received from the FIPB Unit of Department of Economic Affairs, Ministry of Finance [letter nos. FC II356 (96)/610 (95) dated 18 May 2005 and 6 June 2005] & UO no 9(7) / 2002 -chem.. dated 30.09.2002 of Industrial Advisor (Chem.)proving the violation by the units concerned.
